Councilman Carroll's Proposal to Restructure the ARB
AN ORDINANCE TO AMEND SECTION 44-75
OF THE MOBILE CITY CODE RELATING TO
APPOINTMENTS TO THE ARCHITECTURAL REVIEW BOARD

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOBILE, ALABAMA, as follows:
SECTION ONE: That section 44-75(b) of the Mobile City Code is hereby amended so that it now reads in its entirety as follows:
(b) Composition; quorum. The board shall be composed of thirteen (13) members who shall have demonstrated training or experience in the fields of history, architecture, architectural history, urban planning, archaeology or law. Members must be residents of the city. No member of the city council OR THE mayor shall serve on the board. No officer or member of the Executive Board of the Historic Development Commission shall serve on the board. Seven (7) members shall constitute a quorum.
SECTION TWO: That section 44d5(c) of the Mobile City Code is hereby amended so that it now reads in its entirety as follows:
(c) Appointment. Members shall be appointed by the city council as follows:
(1) One (1) from a list of two (2) persons recommended by the Historic Mobile Preservation Society;
(2) One (1) from a list of Iwo (2) persons recommended by the Historic Development Commission in consultation with the historic neighborhood associations;
(3) One (1) person who is a resident of the Ashland Place Historic District and who owns real property located in said District, recommended by the councilperson for City Council District I in consultation with the historic neighborhood associations and the Historic Development Commission;
(4) One (1) person who is a resident of the Church Street East Historic District and who owns real property located in said District, recommended by the councilpEpson for City Council District 4, in consultation with the
historic neighborhood associations and the Historic Development
(5) One (1) person who is a resident of the DeTonti Square Historic District and who owns real property located in said District. recommended by the councilperson for City Council District 2, in consultation with the historic neighborhood associations and the Historic Development Commission;
(6) One {1 I person who is a resident of the Leinkauf Historic District and who owns real property located in said District, recommended by the councilperson for City Council District 3, in consultation with the historic neighborhood associations and the Historic Development Commission;
(7) One (1) person who is a resident of the Oakleigh Garden Historic District and who owns real property located in said District, recommended by the councilperson for City Council District 6, in consultation with the historic neighborhood associalions and the Historic Development Commission;
(t3) One (1) person who is a resident of the Old Dauphin Way Historic District and who owns real property located in said District, recommended by the councilperson for City Council District 5, in consultation with the historic neighborhood associations and the Historic Development Commission;
(9) One (1) person who is a resident of the Lower Dauphin Street Historic District and who owns real property located in said District, recommended by the councilperson for City Council District 7. in consultation with the historic neighborhood associations and the Historic Development Commission
(10) Four (4) from a list of eight (8) registered architects recommended by the Mobile Chapter of the American Institute of Architects
(11). If no resident of a particular historic district is willing to serve on the Board, then a person who is rot a resident of the district may he appointed at the discretion of the councilmember in consultation with the historic neighborhood associations and the Historic Development Commission.
SECTION THREE: That section 44d5(y) of the Mobile City Code is hereby amended so that it now reads in its entirety as follows:
Members of the Board may be removed for cause by the city council. Vacancies on the board for any reason shall be filled in the same manner as their appointment as provided in subsection Ic) of this section - Such appointments shall be for SECTION FOUR: The provisions of this Ordinance are severable. If any part of this Ordnance is declared invalid or unconstitutional by a court of competent jurisdiction, that declaration shall not affect the part or parts that remain.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its adoption and publication as required by law.
